Terms of Service

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User”, “you”) and Melodreams (“Melodreams”, “we”, “us”, “our”). These Terms incorporate by reference our Privacy Policy, available at Privacy Policy.

By accessing, creating an account, subscribing to, or using any part of the Melodreams platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and the Privacy Policy.

If you do not agree with any provision of these Terms, you must not access or use the Service.

1. Definitions

• “Service” means all Melodreams websites, domains, subdomains, applications, APIs, infrastructure, and related services.
• “User” means any individual or legal entity accessing or using the Service.
• “Account” means a registered user profile associated with login credentials.
• “User Content” means any data, text, images, links, media, audio, video, or other materials you submit, upload, or display through the Service.
• “Subscription” means a paid recurring plan required to access the Service.

2. Eligibility & Age Requirement

Melodreams is strictly available only to individuals who are at least 16 years of age.

By using the Service, you represent and warrant that:

• you are at least 16 years old;
• you have the legal capacity to enter into a binding agreement;
• you are not prohibited from using the Service under applicable laws.

Accounts operated by individuals under the age of 16 will be immediately terminated without notice.

3. Regional Availability

Melodreams is not available in all countries or regions. Access may be restricted, limited, or denied based on your geographic location, local regulations, sanctions, or internal compliance requirements.

Attempts to bypass regional restrictions (including the use of VPNs for this purpose) are strictly prohibited.

4. Account Registration & Security

To use Melodreams you must create an Account and maintain an active Subscription. You agree to:

• provide accurate, truthful, and up-to-date information;
• maintain the confidentiality of your credentials;
• not share, sell, or transfer your Account;
• immediately notify us of any unauthorized access or security incidents.

You are fully responsible for all activities conducted through your Account.

5. Subscription, Billing, Payments & Cancellation

Access to the Service requires an active paid Subscription (monthly or yearly).

Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You can cancel anytime through your Account settings. Cancellation takes effect at the end of the current billing period.

Price changes will be communicated to you at least 30 days in advance. If you do not agree with a price increase, you may cancel your Subscription before the new price takes effect. Continued use after the effective date constitutes acceptance of the new price.

Refunds are not provided for partial billing periods unless required by applicable law. All payments are final except where prohibited by law.

Failure to maintain an active Subscription will result in suspension or termination of access.

6. Acceptable Use & Platform Purpose

Melodreams is a non-sexual, non-pornographic, non-extremist, and safety-first platform. You agree to use the Service only for lawful, ethical, and permitted purposes.

You must not:

• use the Service for pornography, adult content, or sexual services;
• promote, host, or link to explicit or fetish content;
• harass, threaten, abuse, or exploit others;
• impersonate individuals or organizations;
• misuse the Service for deception, scams, or fraud;
• attempt to manipulate, disrupt, or overload the platform.

7. Zero-Tolerance Prohibited Content & Mandatory Reporting

The following are strictly prohibited and subject to immediate enforcement:

• Pornography or sexual content of any kind;
• Any sexual content involving minors (absolute zero tolerance);
• Terrorism or extremism, including propaganda, praise, recruitment, or assistance;
• Violence, threats, or graphic harm;
• Hate speech, extremist ideology, or incitement;
• Illegal goods, drugs, weapons, or trafficking;
• Fraud, financial crime, identity theft, or scams.

If we become aware of such content or activity, we will immediately suspend or terminate the Account, preserve data, report to law enforcement, and fully cooperate with authorities. There are no warnings.

8. Anti-Hacking, Abuse & Security Violations

You are strictly prohibited from hacking, probing, scraping, using bots without authorization, circumventing security measures, or interfering with the Service. Violations will result in immediate termination and may be reported to authorities.

9. User Content & License Grant

You retain ownership of your User Content. By submitting User Content, you grant Melodreams a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, reproduce, distribute, display, and make it available as necessary to provide, operate, promote, and improve the Service.

You represent and warrant that you own or have all necessary rights to grant this license and that your User Content does not infringe any third-party rights.

10. Data Routing, Storage & Localization

Your requests may be routed to the nearest available server and your data may be processed and stored in compliant jurisdictions in accordance with applicable data protection laws. By using the Service, you consent to this architecture. See our Privacy Policy for details.

11. Intellectual Property

All Melodreams software, design, branding, infrastructure, and technology are our exclusive property and protected by intellectual property laws. You may not copy, modify, reverse engineer, or extract any part of the Service except as expressly permitted by law.

12. Intellectual Property Infringement Complaints

If you believe any User Content infringes your copyright or other intellectual property rights, please send a written notice to legal@melodreams.com with the required information (description of the work, location on the Service, your contact details, and a good-faith statement). We will investigate and act as required by law (including removal or disabling access where appropriate).

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the Service at least 30 days before they take effect. If you do not agree to the revised Terms, you must stop using the Service and cancel your Subscription. Your continued use after the effective date constitutes acceptance of the updated Terms.

14. Enforcement & Termination

We reserve the right to investigate violations and take any action we deem appropriate, including content removal, account suspension, permanent termination, or referral to authorities. Termination may occur without prior notice.

15. Indemnification

You agree to indemnify, defend, and hold harmless Melodreams, our officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your User Content, or your violation of these Terms.

16. Disclaimer of Warranties

The Service is provided “as is” and “as available”. To the fullest extent permitted by law, Melodreams disclaims all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

17. Limitation of Liability

To the fullest extent permitted by applicable law, Melodreams shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability to you shall not exceed the greater of (i) the total amount you paid to us in the twelve (12) months preceding the claim, or (ii) USD $100.

18. Governing Law & Jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany, excluding conflict-of-law principles. Exclusive jurisdiction lies with the competent courts of Germany.
